  2.                 OneDIR Pro 2.00 HOME USER LICENSE

  4. NOTICE TO HOME USER:  THANK YOU FOR YOUR INTEREST IN ONEDIR PRO.
  5. CAREFULLY READ THE FOLLOWING LEGAL AGREEMENT.  YOU MUST PROMPTLY 
  6. REGISTER YOUR USE OF ONE DIR PRO (THE "SOFTWARE") PROVIDED WITH 
  7. THIS AGREEMENT BY COMPLETING AND FORWARDING TO RICHARD PROFT (THE 
  8. "AUTHOR") THE REGISTRATION FORM LOCATED AT THE END OF THIS DOCUMENT.

  10.      1.     LICENSE GRANT.  If you are a home user, the AUTHOR grants
  11. to you, as an individual, a non-exclusive right to use one copy
  12. of the object code version of the SOFTWARE associated with this
  13. license for personal use on your computer.  This license to use
  14. the SOFTWARE is conditioned upon your compliance with the terms
  15. of this Agreement.  You are entitled to evaluate the software on
  16. a royalty free basis for thirty days.  Use after the thirty day
  17. evaluation period is further conditioned upon payment of the
  18. license fee specified in this REGISTER.TXT file.  This license is
  19. effective for 100 years from the date of your first use or receipt
  20. of the REGISTER.TXT file by the AUTHOR, whichever first occurs.  You
  21. agree you will only copy the SOFTWARE as necessary to use it in
  22. accordance with this license.

  24.      2.     COPYRIGHT.  The SOFTWARE is protected by United States
  25. copyright law and international treaty provisions.  You
  26. acknowledge that no title to the intellectual property in the
  27. SOFTWARE is transferred to you.  You further acknowledge that
  28. title and full ownership rights to the SOFTWARE will remain the
  29. exclusive property of the AUTHOR, and you will not
  30. acquire any rights to the SOFTWARE except as expressly set forth
  31. in this license.  You agree that any copies of the SOFTWARE will
  32. contain the same proprietary notices which appear on and in the
  33. SOFTWARE.

  35.      3.     REVERSE ENGINEERING.  You agree that you will not
  36. attempt to reverse compile, modify, translate, or disassemble the
  37. SOFTWARE in whole or in part.
  38.  
  39.      4.     LIMITED WARRANTY.  The AUTHOR warrants that the SOFTWARE
  40. will perform substantially in accordance with the accompanying
  41. written materials for a period of thirty (30) days from the date
  42. of purchase.  Any implied warranties relating to the SOFTWARE are
  43. limited to thirty (30) days.

  45.      5.     CUSTOMER REMEDIES.  If the SOFTWARE does not conform
  46. to the limited warranty in Section 4 above ("Limited Warranty"),
  47. The AUTHOR's entire liability and your sole and exclusive remedy
  48. shall be, at the AUTHOR's option, either to (a) correct the error or
  49. (b) help you work around or avoid the error.  The Limited
  50. Warranty is void if failure of the SOFTWARE has resulted from
  51. accident, abuse, or misapplication.  Any replacement SOFTWARE
  52. will be warranted for the remainder of the original Limited
  53. Warranty period.
  54.  
  55.      6.     NO OTHER WARRANTIES.  THE AUTHOR DOES NOT WARRANT THAT THE
  56. SOFTWARE IS ERROR FREE.  EXCEPT FOR THE EXPRESS LIMITED WARRANTY
  57. IN SECTION 4 ("LIMITED WARRANTY"), THE AUTHOR DISCLAIMS ALL OTHER
  58. WARRANTIES WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS OR
  59. IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF
  60. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT
  61.  OF THIRD PARTY RIGHTS.  SOME JURISDICTIONS DO NOT
  62. ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON HOW
  63. LONG AN IMPLIED WARRANTY MAY LAST, OR THE EXCLUSION OR LIMITATION
  64. OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS
  65. OR EXCLUSIONS MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES YOU
  66. SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH
  67. VARY FROM JURISDICTION TO JURISDICTION.

  69.      7.     SEVERABILITY.  In the event of invalidity of any
  70. provision of this license, the parties agree that such invalidity
  71. shall not affect the validity of the remaining portions of this
  72. license.

  74.      8.     NO LIABILITY FOR CONSEQUENTIAL DAMAGES.  IN NO EVENT
  75. SHALL THE AUTHOR OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY
  76. CONSEQUENTIAL, SPECIAL, INCIDENTAL OR INDIRECT DAMAGES OF ANY
  77. KIND ARISING OUT OF THE DELIVERY, PERFORMANCE OR USE OF THE
  78. SOFTWARE, EVEN IF THE AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF
  79. SUCH DAMAGES.  IN NO EVENT WILL THE AUTHOR'S LIABILITY FOR ANY CLAIM,
  80. WHETHER IN CONTRACT, TORT OR ANY OTHER THEORY OF LIABILITY,
  81. EXCEED THE LICENSE FEE PAID BY YOU, IF ANY.

  83.      9.     GOVERNING LAW.  This license will be governed by the
  84. laws of the State of Texas as they are applied to agreements
  85. between Texan residents entered into and to be performed
  86. entirely within Texas.  The United Nations Convention on
  87. Contracts for the International Sale of Goods is specifically
  88. disclaimed.

  90.      10.    ENTIRE AGREEMENT.  This is the entire agreement between
  91. you and the AUTHOR which supersedes any prior agreement or
  92. understanding, whether written or oral, relating to the subject
  93. matter of this license.
